1. Acceptance of Terms

By accessing or using Elephant Calorie Tracker ("the App"), you agree to be bound by these Terms of Service. If you do not agree, do not use the App.

2. Description of Service

Elephant Calorie Tracker is a food nutrition analysis app that uses AI technology to estimate nutritional content from food photos. The App provides estimated values for calories, macronutrients, vitamins, minerals, and organ health impact scores.

3. AI-Powered Analysis & Third-Party Services

• Food photos you submit are sent to our server (60bytes.app), which forwards them to OpenAI's API for food recognition and nutritional estimation.
• Only food photos are processed and stored. Non-food or inappropriate images are immediately discarded.
• By using the scan feature, you consent to your food photos being processed by OpenAI. You may revoke this consent in Settings.

3.1 AI Nutrition Chat

• The app includes an AI chat feature that allows you to correct nutritional values after scanning a meal (e.g., adjusting portion sizes, adding or removing ingredients).
• Chat messages are processed by OpenAI's API and are not stored. Chat history is temporary and cleared when you log or cancel the meal.
• The AI chat is strictly limited to correcting nutritional values of the scanned meal. It does not provide medical advice, dietary recommendations, recipe suggestions, or any other guidance.
• All AI-generated corrections are approximate estimates and should not be relied upon for medical, dietary, or health decisions.
• The AI may produce inaccurate corrections. You are responsible for verifying the accuracy of any adjusted values.

4. Medical Disclaimer

Nutritional data is informed by publicly available sources including the USDA FoodData Central, WHO Nutrition Guidelines, and NIH Office of Dietary Supplements.

5. Subscriptions & Payments

• The App offers a free tier with 2 food scans per day.
• Premium subscriptions are available as monthly ($6.99/month) or annual ($24.99/year) auto-renewable subscriptions.
• Payment is charged to your Apple ID account at confirmation of purchase.
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
• You can manage and cancel subscriptions in your Apple ID Account Settings.

6. Acceptable Use

You agree not to:

• Upload inappropriate, offensive, or non-food images
• Attempt to reverse-engineer, modify, or exploit the App or its API
• Use the App for any unlawful purpose
• Circumvent scan limits or subscription requirements

Repeated violations may result in your device being banned from the service.

7. Intellectual Property

All content, design, and technology in Elephant Calorie Tracker are owned by Aranya Cloud Technologies LLC. You may not copy, modify, distribute, or create derivative works based on the App.

8. Data & Privacy

Your use of the App is also governed by our Privacy Policy, which explains what data we collect and how we use it.

9. Limitation of Liability

Elephant Calorie Tracker is provided "as is" without warranties of any kind. We are not liable for any damages resulting from the use of the App, including but not limited to health decisions made based on AI-estimated nutritional values. Nutritional estimates may be inaccurate — always verify with authoritative sources or healthcare professionals.

10. Termination

We reserve the right to terminate or suspend access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or the service.

11. Changes to Terms

We may update these Terms from time to time. Changes will be reflected by updating the effective date above. Continued use of the App constitutes acceptance of the updated Terms.
